Court dissolves 15-year-old marriage over wife's infidelity


An Igando Customary Court in Lagos on Monday dissolved a 15-year-old marriage between a 52-year-old insurance marketer, Omotayo Awodiya, and his wife, Olabisi, following accusation of wife having multiple sex partners.

The petitioner, Awodiya, told the court: “My wife always brings men into our matrimonial home if I am at home or not. “She told me that they are her friends and that she could leave them because she is married.’’

Awodiya said his wife was arrogant and stubborn just because she was richer. “She does not respect me and she talks to me as if she is talking to her housemaid or younger brother.” He urged the court to dissolve the marriage, saying “I am no longer interested.’’ 


Olabisi, a mother of one, who refused to appear in court, however, consented to the dissolution of the marriage through a letter from her lawyer.

The court’s president, Mr Adegboyega Omilola, said that it was obvious that the marriage had hit the rocks. “It is obvious from the testimonies and the respondent’s (wife) refusal to appear in court that the marriage has collapsed. “The court has no choice than to dissolve the marriage,’’ he ruled. “Both parties are free to go their separate ways without any molestation.”

Three accused persons, Akinpolu Ayobami, 20; Oseni Buli, 20; and Sunday Oyedeji, 29; on Monday appeared in a Modakeke Magistrates’ Court for allegedly defiling a 16-year-old girl. Prosecutor Ona Glory told the court that they committed the offence at 8 p.m. at Oke-dio Area, Modakeke in Ife North-East Local Government of Osun on May 9. Glory said that the accused persons were arraigned on a two-count charge of conspiracy and unlawful carnal knowledge of the girl. He said that the accused persons conspired and lured the 16-year-old into an uncompleted building where they defiled her. He told the court the offence contravened Section 357 of the Criminal Code Cap 34 Vol 11, Laws of Osun, 2003. The accused persons pleaded not guilty to the charges. The Magistrate, Mrs Bose Awosan, granted each of the accused bail in the sum of N50,000 with one surety each in like sum. Awosan adjourned the case till June 22 for hearing.
